Terms and Conditions for Waste Collection St. John's Wood
These Terms and Conditions set out the basis on which we provide waste collection services in and around St. John's Wood. By making a booking, confirming a quotation, or allowing our team to collect waste from your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.
1. Definitions
In these Terms and Conditions, the following definitions apply:
Customer means the person, business, company, partnership, or organisation that requests or receives our waste collection services.
Services means any waste collection, removal, loading, transportation, or related service we provide.
Premises means the property or location from which the waste is to be collected.
Waste means the materials, rubbish, junk, or other items that the Customer asks us to remove, excluding any items we specifically refuse or which are prohibited by law.
Agreement means the contract between us and the Customer formed in accordance with these Terms and Conditions.
2. Scope of Services
We provide waste collection and related services for domestic and commercial customers. Our services may include collection of household waste, bulky items, garden waste, office waste, and other non-hazardous materials as agreed at the time of booking.
The exact scope of work, including the type and estimated volume of waste, access arrangements, and any special requirements, will be agreed during the booking process or as set out in our written confirmation or quotation.
We reserve the right to refuse to collect certain items, including but not limited to hazardous materials, chemicals, asbestos, medical waste, pressurised containers, and any items that, in our reasonable opinion, present a health, safety, or environmental risk.
3. Booking Process
Bookings may be made by telephone, email, or through any other method we make available. The Customer is responsible for ensuring that all information provided at the time of booking is accurate and complete, including the address, contact details, description of waste, access restrictions, and preferred collection time.
We may provide an estimated quote based on the information given by the Customer. This quote is subject to change if, upon arrival, the actual volume, type, or weight of waste is different from that described, or if there are unforeseen access issues or additional work required.
A booking is not confirmed until we have acknowledged it and, where applicable, until any required deposit or advance payment has been received. We reserve the right to decline or cancel any booking at our discretion, in which case any payments already made for that booking will be refunded.
The Customer warrants that they are either the owner of the waste and Premises or are authorised by the owner to arrange for the collection and removal of the waste.
4. Access and Customer Obligations
The Customer must ensure that our vehicles and staff have safe and reasonable access to the Premises at the agreed collection time. This includes ensuring that any gates, doors, or access routes are unlocked and unobstructed.
The Customer must provide accurate details of any access restrictions, parking limitations, height or width restrictions, and other relevant information at the time of booking. Any parking charges, permits, or penalties incurred as a direct result of incomplete or inaccurate information may be charged to the Customer.
Where the Customer or their representative is required to be present at the Premises during collection, they must be available at the agreed time. If we are unable to carry out the Services due to the Customer's failure to provide access or attendance, we may charge a missed collection fee.
The Customer agrees not to include any prohibited or hazardous items in the waste unless previously agreed in writing. We may refuse to collect any such items or may charge additional fees for safe handling, in compliance with applicable regulations.
5. Payments and Charges
Our charges are normally based on the type and volume or weight of waste collected, as well as any additional labour, waiting time, or special requirements. All prices will be communicated to the Customer before or at the time of booking, or upon inspection of the waste at the Premises.
Unless otherwise agreed, payment is due at the time of collection and may be made by cash, debit or credit card, bank transfer, or any other method we accept. For business customers, we may agree alternative payment terms in writing.
We reserve the right to request a deposit or full payment in advance for any booking. Where a deposit is taken, it will be deducted from the final charge. If the actual cost of the Services exceeds any prior estimate given, the Customer will be notified and must approve the revised cost before we proceed, unless the difference is minor and results directly from reasonable variations in the waste volume or type.
If payment is not received when due, we may refuse to provide or continue the Services, and we may charge interest on any overdue amounts at the statutory rate. The Customer shall also be liable for any reasonable costs we incur in recovering unpaid sums, including legal fees and collection agency charges.
6. Cancellations and Amendments
The Customer may cancel or amend a booking by giving us reasonable notice prior to the agreed collection time. Unless otherwise stated, we ask for at least 24 hours' notice to cancel or make changes without charge.
If the Customer cancels a booking with less than 24 hours' notice, we may charge a cancellation fee to cover our administrative and operational costs. If we arrive at the Premises and are unable to carry out the Services due to circumstances within the Customer's control, we may treat this as a late cancellation and charge accordingly.
We will use reasonable efforts to accommodate any request to amend a booking, such as altering the collection time or adding extra waste. However, amendments are subject to availability and may result in changes to the quoted price.
We reserve the right to cancel or reschedule a booking if we are unable to fulfil it due to circumstances beyond our reasonable control, including adverse weather, vehicle breakdown, staff illness, or safety concerns. In such cases, we will notify the Customer as soon as reasonably possible and offer an alternative collection time. Where we cancel and cannot offer a suitable alternative, any payments already made for that booking will be refunded.
7. Waste Handling and Regulations
We operate in accordance with applicable UK waste management and environmental regulations. All waste collected will be transported and disposed of or recycled at licensed facilities, as appropriate for the type of waste.
The Customer is responsible for accurately describing the nature of the waste. Where the waste differs materially from the description provided and requires special handling or is subject to additional regulatory controls, we may refuse to collect it or may adjust the price to reflect the additional requirements.
Once waste has been loaded onto our vehicle and payment has been made, title and responsibility for that waste normally pass to us. However, if we discover that the waste includes prohibited or unlawfully presented items, we reserve the right to return such items to the Premises or to require the Customer to arrange appropriate disposal at their own cost.
We encourage Customers to separate recyclable materials where possible. However, unless we have agreed a specific recycling service, we cannot guarantee that all items will be recycled. Our disposal and recycling routes may change from time to time in line with regulatory and commercial requirements.
8. Liability and Limitations
We will use reasonable care and skill in providing the Services. Our staff will take reasonable steps to avoid damage to the Premises when removing waste. However, the Customer acknowledges that minor scuffs, marks, or wear may occur where large or heavy items are removed from confined spaces or difficult access areas.
We shall not be liable for any damage to the Premises or property where such damage arises from pre-existing defects, structural weaknesses, poor installation, or where the Customer has requested that we proceed despite our advice regarding risk.
Our liability for loss or damage arising from the provision of the Services shall, to the fullest extent permitted by law, be limited to the total price paid or payable by the Customer for the specific booking giving rise to the claim.
We shall not be liable for any indirect or consequential losses, including loss of profit, business interruption, loss of data, or loss of reputation, whether arising in contract, tort, or otherwise, and whether or not such losses were foreseeable.
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under UK law.
9. Customer Indemnity
The Customer agrees to indemnify and keep us indemnified against any claims, costs, damages, fines, or expenses arising from:

Any incorrect or misleading information provided regarding the waste or Premises.
The inclusion of prohibited, hazardous, or illegal items in the waste without our prior written agreement.
Any claim by a third party that the Customer did not have the authority to arrange removal of the waste from the Premises.
10. Complaints
If the Customer is dissatisfied with any aspect of the Services, they should contact us as soon as possible, providing full details of the issue. We will investigate the complaint and use reasonable efforts to resolve it promptly and fairly.
Where appropriate, we may offer a remedy such as a partial refund, a re-visit, or an alternative solution, at our discretion and in line with our legal obligations.
11. Data Protection and Privacy
We collect and process personal information such as names, contact details, addresses, and payment information in order to provide our services, manage bookings, and handle queries. We will only use personal data in accordance with applicable data protection legislation in the UK.
We take reasonable steps to keep Customer information secure and will not share personal data with third parties except where necessary to provide the Services, meet legal obligations, or with the Customer's consent.
12. Changes to These Terms
We may revise these Terms and Conditions from time to time to reflect changes in our services, legal requirements, or business practices. Any updated terms will apply to new bookings made after the date of publication.
For ongoing business arrangements, we will notify Customers of any material changes in advance where reasonably practicable. Continued use of our services after such notification will constitute acceptance of the revised terms.
13. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our waste collection services.
14. General Provisions
If any provision of these Terms and Conditions is held to be invalid, unlawful, or unenforceable by a court or competent authority, that provision shall be deemed deleted, but such deletion shall not affect the validity and enforceability of the remaining provisions.
No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy. Any waiver must be in writing to be effective.
The Agreement is between us and the Customer. No other person shall have any rights to enforce any of its terms.
These Terms and Conditions set out the entire agreement between us and the Customer in relation to the provision of the Services and supersede any previous understandings, agreements, or arrangements, whether oral or written.
